2013 Supreme Court Intellectual Property Cases

The United States Supreme Court has announced that it will hear four intellectual property cases during the 2013 term:

  • Bowman v. Monsanto (patent exhaustion in second generation of crop seeds)
  • Kirtsaeng v. John Wiley & Sons, Inc. (international copyright exhaustion and importation)
  • Already, LLC v. Nike, Inc. (impact of limited covenant-not-to-sue on declaratory judgment jurisdiction in trademark law)
  • Gunn v. Minton (whether legal malpractice claims arising out of representation in a patent dispute should be heard by the Federal Circuit)

The Court may hear additional cases which have filed petitions for review by the Supreme Court but which the Court has not yet indicated that it will review.
