New Copyright Office Proposal for Group Registration of Visual Art (GR2D)

As a general rule, a copyright registration covers an individual work, and you must prepare a separate application and submit a separate filing fee and deposit for each work you want to register. Under the recently proposed copyright rules, artist can register multiple works of two-dimensional artwork, such as illustrations, paintings and drawings in a single application.

In a groundbreaking move, the United States Copyright Office has recently proposed new rules that offer exciting opportunities for creators of two-dimensional artwork. These changes, outlined on February 15, 2024, promise to streamline the copyright registration process for Group Registration of Visual Art, referred to as (GR2D).

The Proposed Group Registration for Two-Dimensional Artwork

As a general rule, a copyright registration covers an individual work, and you must prepare a separate application and submit a separate filing fee and deposit for each work you want to register. The proposed rules would allow for the group registration of multiple works of two-dimensional artwork, such as illustrations, paintings and drawings in a single application. This means that instead of filing individual copyright applications for each individual work of art, under the proposed rules, you can submit a single application to cover a group of related works.  In the past, group registrations were limited to collective works, bundled works, photographs, various unpublished works, newspapers, newsletters, periodicals, database updates and testing materials.  Up until now, painters, graphical artist and illustrators could not submit their work as a group registration.   

Visual artists are often prolific creators who depend on a large volume of artwork to earn a living.  These works of visual art can be particularly susceptible to infringement because in many cases they are fixed in a digital file that can easily be copied and distributed without the artists permission, even if the file includes copyright management information or technical protection measures.  Because of the registration costs associated with registration, most visual artists do not register each of their works, despite this risk of copyright infringement.  However, before you can enforce your copyrights you have to register your work with the copyright office.  The group registraiton for two-dimension visual art proposal was developed to help lower the burden for registration of artwork by providing a single-fee for up to ten works of visual art.
